The plaintiff argues that the defendant’s conduct has had an adverse emotional impact upon the children’s wellbeing and has also caused her considerable anguish, which in turn affected the children. The plaintiff argues that the defendant’s conduct affects his capacity to parent and his ability to appropriately exercise the rights and duties of a guardian or custodial parent. Relying on Van de Perre v. Edwards, 2001 SCC 60 ¶23, the plaintiff submits that the defendant cannot be entrusted to foster a relationship between the children and the non-custodial parent.
