The by-laws which affect the cost of replacement in this case were in effect at the time this policy was renewed. As Murphy J. said [p. 468n] in McCoy v. North Empire Fire Ins. Co., [1918] 1 W.W.R. 468n: "… all persons in a municipality whether permanent residents or not are bound to take notice of its by-laws".
