The authority to impose conditions and restrictions on the “rights, privileges or powers” of a committee is found in s. 16 of the PPA. In the alternative, if s. 16 is not broad enough to authorize these conditions and restrictions, I would invoke my parens patriae jurisdiction to include such provisions in the committeeship scheme pursuant to a legislative gap. In Temoin v. Martin, 2011 BCSC 1727, aff’d 2012 BCCA 250, Madam Justice Fisher applies the parens patriae jurisdiction in a separate issue in the PPA. She summarized:
