An amendment should be allowed if it can be made without injustice to the defendant. There is no injustice if the defendant can be compensated with costs: White v. Pellerine (1988), 84 N.S.R. (2d) 341 (S.C.A.D.) at para. 3. Where the parties would not have conducted the proceeding differently, and further evidence is not required, it has been held that leave should be granted: White at para. 6.
