The only legal authority cited by the parties in relation to statutory privilege is Yellowbird v. Lytviak, 1998 ABQB 272. This is a decision of an Alberta Master relating to prohibitions against disclosure of certain hospital committee reports contained in that province’s Evidence Act. The chambers judge relied on that sole authority cited to her for the proposition that the wording of a statute purporting to create a statutory privilege must be construed narrowly.
