Depending on the circumstances, a summary judgment motion may be the appropriate vehicle for adjudication of claims arising from a failed real estate deal like this one. In Winch v. He, 2019 ONSC 5874, for example, I found that the facts were not complex and did not involve competing narratives. There was accordingly no need for the court to hear from witnesses directly or for the parties to develop a more complete evidentiary record.
