In Stewart v. Elk Valley, supra, the employer had a “no free accident” rule. Employees were required to disclose any dependence or addiction issues before any drug related accident occurred. If they so reported, they would be offered treatment. If they did not report and were subsequently involved in a work place accident and tested positive for drugs, they would be dismissed.
