In Boston v. Boston, 2001 SCC 43, the majority held that absent certain conditions there is no reason spousal support cannot continue after the payor spouse has retired. The payor/applicant must demonstrate that there has been a material change in the circumstances of the parties and a reduction in income following retirement to constitute a material change.
