In Saric v. Toronto-Dominion Bank (1999) B.C.J. No. 1712 Vancouver Registry No. CA025775 (B.C.C.A.), Hall J.A. in chambers, dealt with an application for leave to appeal a decision of Low J. who had decided that the documents were sufficiently described in the affidavit claiming privilege. Hall J.A. commented that Low J. observed: ... that if more detailed descriptions had been given, that this would tend to defeat the purpose of the privilege and amount to an unwarranted invasion of the brief of counsel.
