In such a situation, the occupier becomes a monthly tenant. With continued occupation of the premises, the principles of equity apply for the payment of reasonable compensation. Where the lease is no longer enforceable, the appropriate compensation as to what is reasonable is to be determined by the court based on the facts. (see Samad v. Samad, supra, paras. 65 and 65)
