In applying the s. 95 factors, the court must first determine the full extent of the family property and debt in accordance with ss. 84 and 85, and then notionally divide that property and debt equally. The court will then assess whether the notional equal division would be significantly unfair: Remmem v. Remmem, 2014 BCSC 1552 at paras. 30 and 43.
