The petitioner argues that to obtain a building permit, a person is required to sign a disclaimer indemnifying the RDCK from any responsibility and if they do not do so, the RDCK will not issue a building permit. He maintains s. 14.1 is unauthorized in law, illegal and unlawful pursuant to Kamloops v. Neilsen, 1984 CanLII 21 (SCC), [1984] 2 S.C.R. 2. He also refers to contract law.
