In Radke v. M.S., 2005 BCSC 1355, Bennett J. found the police officer acted negligently because he engaged in a pursuit when he had the opportunity to disable a stolen vehicle, contain it by setting up a perimeter or follow it using an unmarked car. The police pursuit policy included a provision that “pursuit may only be initiated and continued when other alternatives are not available.”
