Whether I am correct in drawing that latter inference from the above ratio, I am content to leave that reconciliation to others, for I find that the “original evidence” cases are distinguishable on their facts from the circumstances here. To the extent that any of the statements in this case are not distinguishable, I believe I am bound by the principles found in R v. Smith and R v. Starr.
