In this case, neither party was successful: Fleming v. Chief Constable of Sussex Police Force, [2004] EWCA Civ 643 at para 25. Both Peace Hills and Syryda agreed to proceed by petition and resolve the matters that were outstanding between them. Syryda did not oppose this procedure.
