As Hinds, J.A. in Newham v. Newham, [1993] B.C.J. 2036 observed at paragraph 29 In this case the respondent was successful on the major issues of custody and maintenance. She was also successful in the minor issue concerning the allocation of chattels. It is apparent she did not achieve all that she sought on the division and allocation of family assets. Nevertheless, looking at the issues as a whole, the respondent was the substantial winner at trial.
