What is the effect of a spouse’s argument that the value of their property is to be divided according to the value it retains at the time of trial?

Alberta, Canada

The following excerpt is from Ross v. Ross, 2007 ABQB 167 (CanLII):

This is particularly troubling as in Alberta, it is settled law that matrimonial property is to be divided according to the value it retains at the time of the trial: Hodgson v. Hodgson, 2005 ABCA 13. Given this unambiguous rule of matrimonial property division, the spouses’ lengthy submissions as to the value of various assets and debts at other times become largely irrelevant. It is with this overarching caveat in mind that I deal with the substantive aspects of this application.
