To the extent that I indicated in my previous judgment that pre-judgment interest in a matrimonial action is no different than any other action, I erred. That is not the law. The law is as set out in Deyell v. Deyell, supra. The Pre-judgment Interest Act does not apply to matrimonial property actions. The application to amend the pleadings of the wife by including a claim for pre-judgment interest must, therefore, be dismissed.
