45. The defendant relies on the SCC decision of The Maritime Life Assurance Company v. Saskatchewan River Bungalows Ltd. This case dealt with whether Maritime had waived its right to compel timely payment of premiums in accordance with the policy terms. The court found that ultimately, there was no waiver, as the defendant had tendered payment of the missing premium.
