What is the test for determining whether a party can obtain relief from the Court of Appeal?

British Columbia, Canada

The following excerpt is from Watt v Health Sciences Association of British Columbia, 2018 BCSC 512 (CanLII):

The relief sought is discretionary. In exercising its discretion a court must “decide whether the degree of commonality and intertwining of issues as revealed in the pleadings outweighs prejudicial factors raised by the party opposing the order” (Liu v. Tsai, 2017 BCSC 221 at para. 4).
