However, the case of Ivey v. Canada Trust Co. has not been followed in Alberta and is readily distinguishable from the present matter in that Ivey did not involve documents referred to in pleadings, as here: there was no request for their production under the equivalent of R. 191; nor is there any indication that the documents in question went to the root of the claim or defence, as here.
