The Seventh Circuit recently confronted a similar situation, United States v. Crouch, 528 F.2d 625, 632-33 (7th Cir. 1976). There the prosecution called a witness knowing that he would invoke his Fifth Amendment privilege. After doing so before the jury, the witness was given a grant of immunity and testified freely. The court held that there was no prosecutorial misconduct when there was no evidence of an impermissible attempt to bolster the prosecution's case and when the witness was subject to cross-examination.
