Bearing some factual resemblance to Massiah v. United States (1964), 377 U.S. 201, 84 S.Ct. 1199, 12 L.Ed.2d 246, People v. Rogers, supra, 22 Cal.2d 787, 141 P.2d 722, decided in 1943, rejected a confession made to one, not a police officer, who was an agent of the police for that purpose.
