Amendment. Estelle v. Gamble, 429 U.S. 97, 104-05 (1976). A violation of the Eighth Amendment occurs when a prison official is deliberately indifferent to a prisoner's serious medical needs. Id. At most, plaintiff alleges in his complaint facts which amount to negligence and not deliberate indifference.
