The methodology I must observe and the factors which I am to consider in the order recommended in Regina v. Morin at p. 10, 17 et. seq. and as per step one of the test in Morin requires me first to consider waiver of time periods. It was not suggested by either counsel before me that the accused waived any relevant time period with respect to the application before me. I find none. I will deal with the delay to the second trial date below under the actions of the accused.
