I also consider the prejudice to be suffered by the respondent if the appeal were permitted to continue. The respondent is entitled to finality (Siscoe v. Nova Scotia (Workers’ Compensation Appeals Tribunal), 2020 NSCA 81 at para. 21) and in my view would be equally prejudiced by allowing the appeal to continue under all of the circumstances.
