The following excerpt is from People v. Anderson, 103 Cal.Rptr. 891, 27 Cal.App.3d 518 (Cal. App. 1972):
At the habeas corpus hearing the People were represented by a deputy attorney general and a deputy district attorney, the former being concerned merely with the opposition to the habeas corpus petition. In this effort he was unsuccessful and the conviction on count V was vacated and [27 Cal.App.3d 521] the guilty plea withdrawn. In accordance with the procedure suggested in People v. Daniels, Supra, 71 Cal.2d at page 1143, 80 Cal.Rptr. 897, 459 P.2d 225, the eight counts which had been dismissed on February 5, 1968, were reinstated.
