In Solowoniuk v. Morash, 2000 BCSC 1840, a man (age unknown) suffered injuries that resulted in neck, shoulder and back pain and headaches when his vehicle was rear-ended. He was incapacitated for three months. Two years after the accident, the plaintiff suffered ongoing back problems, which prevented him from returning to the form of employment that he pursued before the accident. He did pursue part-time light duties. Ongoing pain interfered with the plaintiff's enjoyment of such activities as gardening and cooking and made him more irritable.
