The following excerpt is from Kornievsky v. Chi. Title Co., G051337 (Cal. App. 2016):
Because of the extensive litigation spawned by the property transactions at issue, we have already addressed some of the issues raised in this appeal. In particular, we have analyzed plaintiffs' claim that the discovery rule tolled the statute of limitations, rendering their complaint timely. We concluded that plaintiffs adequately pleaded the discovery rule. (See Kornievsky v. CBRE, Inc. (Feb. 9, 2016, G050319) [nonpub. opn.].) We do not repeat that analysis here. Instead, we address the merits of plaintiffs' claims and affirm the trial court's finding that plaintiffs failed to state a cause of action.
