If a relief worker is injured while working shoulder to shoulder with a regular county employee, is that poor relief worker entitled to the same benefits as a full-time county employee?

California, United States of America

The following excerpt is from Hoppmann v. Workers' Comp. Appeals Bd., 226 Cal.App.3d 1119, 277 Cal.Rptr. 116 (Cal. App. 1991):

The decision also noted that "[t]here is no sound reason for discriminating against a poor relief worker who may be injured while working shoulder to shoulder with a regular county employee who would be entitled to [226 Cal.App.3d 1125] benefits...." (Id. 30 Cal.3d at p. 402, 179 Cal.Rptr. 214, 637 P.2d 681, quoting from Scissons v. City of Rapid City (S.D.1977) 251 N.W.2d 681, 687.)
