In Hillman v. Macintosh the plaintiff, who was injured on the defendant’s lands, was an express company messenger who was to pick up a parcel from a tenant in the defendant’s building and was injured in a freight elevator that was provided by the landlord. The court held there was a common interest between the plaintiff and the defendant and also found that the plaintiff was an invitee of the defendant landlord.
