I am also in agreement with the words of R. Smith J. in Blackburn v. Fortin, 2006 CarswellOnt 3458 where he talked about the delicate balance between the rights of parents and contact with grandparents: 37 Counsel for parents acknowledged that maintaining contact with a grandparent is generally in the grandchildren's best interests, however this benefit must be weighed and balanced against the parents' right to decide who is entitled to have access to their children. I agree that I must weigh the potential benefits to the grandchildren, by maintaining and developing a relationship with their grandmother, against the potential adverse effects on the children, if the parents' right to decide who is permitted to have access to their children, is to be overridden by a court order.
