As our Court of Appeal said in Schaerer v. Schaerer, 2021 ABCA 104, at paragraph 21, “an order restraining the liberty of a parent is an extraordinary remedy.” That is often overlooked when EPOs are deployed prematurely or inappropriately. In family cases, they have the effect of creating significant ripples and imbalances in family ecosystems that are often not easily undone.
