The fact that the court acted in excess of its jurisdiction does not affect our decision to affirm the judgment. Where, as here, the court has fundamental jurisdiction and a party requests or consents to an act beyond the court's power as defined by a directory provision of a statute, the party may be estopped from complaining of the ensuing action taken in excess of the court's jurisdiction.
