The following excerpt is from People v. Campos, C061346, No.72005524 (Cal. App. 2010):
Deputy Public Defender Young stated only that "Defendant feels that the District Attorney was not negotiating in good faith...." (Italics added.) The fact Young did not support defendant's claim that she had told him the prosecutor had a personal dislike for her demonstrates defendant's claim lacks credibility. In any event, defendant fails to explain how the trial court could be expected to hold sua sponte a hearing based on declarations attached to a notice of appeal, which generally divests the trial court of jurisdiction in the case. (People v. Alanis (2008) 158 Cal.App.4th 1467, 1472-1473 [valid notice of appeal divests trial court of jurisdiction over any matter affecting judgment].)
