42 Because we find no prejudicial error, we do not address whether the stipulation of counsel was in effect a waiver of defendant's right to exclude the remaining sections of the report from consideration. (See People v. Gonzalez, supra, 51 Cal.3d 1179, 1238, 275 Cal.Rptr. 729, 800 P.2d 1159.)
