Does a product liability cause of action need to be time-barred on appeal?

California, United States of America

The following excerpt is from Barton v. Elias, E068331 (Cal. App. 2019):

7. While the dental defendants argue that the products liability causes of action are time-barred on appeal, they did not argue that below, and the trial court did not grant summary adjudication on that basis. We therefore gave the parties an opportunity to submit supplemental briefing on this issue also. ( 437c, subd. (m)(2); City of Monterey v. Carrnshimba, supra, 215 Cal.App.4th at p. 1096, fn. 24; see ante, fn. 6.)
