Both counsel agree that the guidelines are simply one tool, among others, for determining an appropriate level of spousal support. The proposed guidelines have not yet been adopted. Even if they are adopted, they will not be binding: Yemchuk v. Yemchuk, 2005 BCCA 406. While the guidelines are one item that may be considered, they do not displace or override the primary responsibility of the court, which is to apply the principles, factors and objectives set out in the governing statute, the Divorce Act, particularly ss. 15.2(4) and 15.2(6).
