On December 1, 2008, Madam Justice Humphries delivered reasons for judgment on the costs of the defendants’ five applications, indexed as Nazmdeh v. Ursel, 2008 BCSC 1632, with supplemental reasons at 2009 BCSC 19. Humphries J. determined that the parties would bear their own costs of the application for the independent medical examination of the plaintiff, and that the defendants were entitled to costs in any event of the cause on the remaining four applications. Her Ladyship ordered that the costs of two of those applications were payable by the plaintiff and that the costs of the other two applications were payable personally by counsel for the plaintiff.
