A left turning driver is considered the servient driver and the oncoming driver, going straight through the intersection, is considered the dominant driver. A dominant driver has the right of way; the servient driver has the obligation to yield the right of way: Dawes v. Valadas et al., 2005 BCSC 1319 at paras. 33-34.
