Does section 22 (2) (c) of the Child Support Guidelines apply where the child has lived with grandparents in Ecuador for 2 and one half years?

Ontario, Canada

The following excerpt is from Dorya v. Dorya, 2015 ONCJ 24 (CanLII):

In Vega v. Vega[9] section 22 (2) (c) was applied where the child had lived with grandparents in Ecuador for two and one half years, more than half of her life. The court held it had no jurisdiction to determine custody as the child had lived in Ecuador for a significant amount of time both with respect to the actual time and the time as compared to the child’s age.
