The plaintiff’s lack of response to the letter purporting to “cancel” the agreement subsequent to his failure to make payment of the purchase price on the due date, gave the vendor the right to treat the non-payment as an abandonment of the agreement for sale: Cushing v. Knight (1912), 1912 CanLII 26 (SCC), 46 S.C.R. 555.
