Craiggs was considered in Tsoi v. Lai, 2012 BCSC 1082 [Tsoi]. There, the plaintiff sought judgment for monies loaned to the defendant. The defendant maintained the monies were not recoverable because the parties knew the funds were to be used for an illegal purpose; specifically, so that the defendant could lend funds to gamblers in his mah-jong business. The court found that both parties were aware of the purpose of the monies that had been advanced.
