Costs Counsel contends that the order awarding costs to the successful defendants on the motion was made without hearing submissions as to the propriety of a costs order in favour of the successful parties, i.e. the defendants. In support of this proposition, he cites the case of Arabi v. Toronto-Dominion Bank, [2006] O.J. 5011 (S.C.J.).
