In Wiebe v. Bobsien Bouck J. made the following useful observations: At p. 189 he stated: A condition precedent may be of a nature that creates no binding agreement or it may just act as an ingredient which suspends performance of an otherwise complete contract. It all depends upon the intention of the parties as expressed in the contract itself and as shown by surrounding events.
