The purpose of the class definition was set out in Bywater v. T.T.C. (1998), 27 C.P.C. (4th) 172, [1998] O.J. No. 4913 (S.C.J.): (a) It identifies those persons who have a potential claim for relief against the defendants; (b) It defines the parameters of the lawsuit so as to identify those persons who are bound by its result; (c) It describes who is entitled to notice pursuant to the Act.
