Section 9 of the Guidelines was considered in Green v. Green 2000 BCCA 310. In Green, Madam Justice Prowse identified three common formulaic approaches to the calculation of child support in split custody or 40% access cases: (1) Percentage of time spent with the payee multiplied by the guideline amount for the payor less the percentage of time with the payor multiplied by the guideline amount for the payee. (2) Percentage of time with the payee multipled by the income of the payor. (3) Same as (1) but the resulting child support amount to be multiplied by 1.5.
