In Chan v. Insurance Corporation of British Columbia, 2000 BCSC 1229, the plaintiff was involved in a hit and run accident as she drove home in the early morning hours. Immediately following the accident, she exited her vehicle and, against the “don’t walk” sign ran across the road toward a witness who was standing on the corner. The witness pointed the plaintiff to the location of the unidentified vehicle which had stopped a short distance away. Again against the “don’t walk” signal and without looking out for traffic, the plaintiff was struck by another vehicle in the roadway when she, in an attempt to identify the vehicle that had hit her, ran in the direction of the unidentified vehicle.
