The law has recognized that married couples and unmarried couples are entitled to equal treatment, for example with respect to insurance regime benefits, and that treating married couples differently from unmarried couples may be discriminatory and violate the equality guarantee of s. 15 of the Canadian Charter of Rights and Freedoms: Miron v. Trudel, 1995 CanLII 97 (SCC), [1995] 2 S.C.R. 418 (S.C.C.).
