Preliminary, we note that since these matters were not raised by the prosecuting attorney at the preliminary hearing, we could well consider that they were waived (People v. Stanley, 206 Cal.App.2d 795, 24 Cal.Rptr. 128). However, we deem it our duty to discuss and dispose of the People's contention as it is one of first impression.
